Jordan Neely Subway Death Trial, The former US Marine Daniel Penny’s trial has begun. Penny is charged with killing Jordan Neely on a New York City subway train. In May 2023, Penny, 25, is accused of putting Neely, a 30-year-old homeless Black man, in a fatal chokehold and committing negligent homicide. Prior to Penny stepping in and apparently keeping Neely down for many minutes until he passed away, Neely had been yelling and begging for money on the train.

The incident, captured on video by bystanders, quickly ignited political and social debates. While civil rights groups and other critics denounced Penny as a vigilante who overreacted to a non-violent situation, some conservatives celebrated him as a hero. Despite having previous offenses and a history of mental health issues after his mother’s murder, Neely did not injure anyone physically on that day’s subway ride. Witnesses reported that he was making desperate statements, but there was no indication of violent actions.

If Penny is found guilty of manslaughter, she could spend up to 15 years in prison. The trial is scheduled to run six weeks. He entered a not guilty plea, arguing that he acted in self-defense out of concern for other passengers as well as for his own safety. Neely’s death has sparked continued concerns about the use of force and its effects by drawing comparisons to other well-known chokehold deaths, such as those of Eric Garner and George Floyd.

Jury selection began this week, with protesters gathering outside the courthouse demanding justice for Neely.
